Witness defends 2PM’s Nichkhun despite the public release of accident video, is pointless

A new wrinkle has been thrown into the events of 2PM‘s Nichkhun‘s drunk driving scandal, where a witness has come forward to say that Nichkhun wasn’t 100% at fault.

While I don’t mind new facts coming forward, the witness account is puzzling, especially when contrasted with the actual video of the event.

“Nichkhun’s vehicle and the motorcycle were coming towards each other at the Ahn Sae Hospital four-way intersection in a cross direction,” the witness began. “The motorcycle was coming down the road, and Nichkhun’s vehicle was driving up. The motorcycle was on the left making a right, when it bumped into the right side of Nichkhun’s vehicle.”

I honestly don’t get this account at all.

Where was the motorcycle turning? Look at the GIF:

I’m not a fucking physicist or anything, but I’m quite certain that the motorcycle isn’t turning right.

If the motorist was turning right (or anywhere, really), he would have to go backwards to get onto either road. He was past the halfway point of the intersection when he got hit (at least), so … uh … shitty witness right from the start.

After the initial collision, Nichkhun’s vehicle had suffered a few scratches. The witness then explained, “I think the secondary shock had caused the body of the motorcyclist to turn and hit the right side of Nichkhun’s car near the tire. With that said, I think Nichkhun had the chips on his car because the body of the motorcyclist had run into it.”

Yeah, I’m quite certain he did try to turn, you know, because of the fucking car that appeared out of nowhere.

“I would say both drivers were driving poorly,” the witness continued. “This accident is not 100% Nichkhun’s fault. Both drivers were speeding, and even if they did come to an abrupt stop, it was not a situation where they could have avoided an accident.”

I agree with this. Shit is rarely ever 100% anybody’s fault in accidents. That would be true even if Nichkhun was drunk off his ass, which is why determining what “evasive measures” the victim took is standard procedure for police. However, “not 100% his fault” and “it’s okay to be drunk and/or speeding in a car and/or ignoring traffic laws” are completely different things.

All the people who are currently disturbingly celebrating about this news article like it’s awesome for Nichkhun need to get a fucking grip.

“I think this will have a huge impact on Nichkhun’s image. I hope he does not suffer too much harm because of this,” the witness added.

Really? Really?! Witness sounds like a fangirl, for real.

I dunno what the point of this article was, honestly. The witness can say whatever, but the public already has the video. The point the witness leads with can be proven wrong simply by watching the said video, which makes everything else said highly suspect. Besides, eyewitness testimony is notoriously inaccurate, even in more important matters than this, so I’m unclear why people are taking this seriously when we already have evidence of what happened.

In other news pertinent to these events, the police have said alcohol was not a factor in the accident … despite Nichkhun being intoxicated enough to suspend his license.

Got that?

In regards to the collision, Seoul’s Gangnam Police Station currently investigating the incident also ruled that Nichkhun’s drinking had nothing to do with the accident itself. The police have not received a statement from the motorcyclist about the accident, and therefore the police plan on revisiting the scene of the accident to do some on-the-spot inspection once they receive a written report from the driver. The two driver’s negligence in regards to the accident will be determined then.

So an accident occurred because neither party reacted in time to avoid a collision, and Nichkhun was intoxicated enough to suspend his license with a substance that is well known to do stuff like slow reaction time, yet it had nothing to do with the accident?

That’s a completely asinine conclusion to reach for everybody with a brain, right? Just checking.

While it’s true that the motorcyclist could have been on PCP and shrooms for all we know, the reason Nichkhun is catching shit is not because people think he’s absolutely 100% at fault for everything. Rather, it’s the fact that he was driving while intoxicated, that he ignored traffic laws (was speeding too, apparently), and that as a result he drilled some poor dude on a motorcycle and sent him to the hospital.

Debate the percentage of fault all you want, but unless the police and media are just flat-out lying about everything and the CCTV video was fabricated in some grand conspiracy, the fact of the matter is that Nichkhun still fucked up and does deserve backlash for what he did.

So please stop trying to excuse everything from speeding to drunk driving just because you want to believe everything is okay. It’s ridiculous.

    The whole witness account smells really fishy. It contradicts the video evidence so I don’t know why anyone would buy into that account unless to bolster some misguided hope that Nickhun is somehow innocent or not as guilty as he actually is.

    I have been a witness of car accidents twice in my life I have to say that testimonials shouldn’t be taken as 100% accurate truth.

    Yes, you do “see” the accident but you aren’t really paying attention until the crash itself ocurrs.

    So your memories about the seconds before the accident are quite blurry (1. because you were probably minding your own bussiness and not staring at the traffic. 2. because everything happens super quickly) but you tend to “complete” them later in order to answer the police’s questions.

  10. Just like the Daesung case. When the taxi driver gave his testimony, fans were like “Omg I’m so glad he gave his honesty to the police to help Daesung! He really stepped up and share everything that really happened!!!” (how can someone be so detailed, even with how fast they were going exactly, all within a matter of seconds and can even see everything Daesung did from behind another car that was in front of him? I dunno) But his account was just as faulty too and people only believe the words of the taxi driver/witness because it made it sound less Daesung’s fault.

    Exactly how it is here and how fans will jump up on this witness so-called account. “OH so really it was the cyclist’s fault because he was trying to turn right!!! THEN he dumped into Nickhun’s car!!! He’s less guilty!!!!!! It didn’t even matter if he had alcohol!” Just like how Daesung was speeding a bit in his car, people act like it wouldn’t have matter if he did or not he would’ve still hit the body. So as with this, if the alcohol wasn’t in his system he may have had faster reaction time. I dunno… those fans seriously can’t be lawyers because it taken to court, that’s exactly what they’re going to say just like what would be said if Daesung wasn’t speeding. (It still goes against them because they still did the major damage and law breaking, especially drinking/driving)

    How is he even trying to turn right!? He didn’t even make any indication he was even about to turn (well despite lack of blinkers that can’t be seen) His motorcycle wasn’t even swerving a bit to turn right… it went straight.

  13. If that is the real video of the incident and what IATFB is saying is true about that being the main road(with no traffic lights) then it’s completely 100% Nichkhun’s fault. Intoxicated or not, he was supposed to stop or yield for incoming cars yet he just kept going at full speed. Being drunk should give him an even harsher punishment, but I wouldn’t even be surprised if he got away with this.

  23. On Allkpop, they blamed the motorcyclist. They said, if he wore a helmet, he wouldn’t be injured in the first place which is stupid.
    However, was he actually drunk? People are saying he was 0.005% over the limit. I don’t drink, therefore I don’t know much about the severity of his alcohol level.

    • i think he had around 2-3 beers. alcohol tolerance can vary, like some people get drunk really easily while others don’t regardless of BAC. but its still a DUI according to the law and there are consequences for that. he might not have been totally wasted but the fact that this resulted in an accident basically proves he wasn’t fully alert and could’ve been more responsible =/

    • I wouldn’t necessarily say that. Him being edited out of variety shows and CFs are a big deal. Those bring in a lot of income and he’s practically the face of 2PM. Since he makes the most, this is going to impact 2PM in a huge way.

      We might be looking at a hiatus in the near future. Let’s not forget that he’s not Korean. Oh, I can just see the anti-Thai remarks from a thousand miles away.

  28. Sounds like a pay off to me. Just the way the witness described everything–from how Nichkhun’s car was damaged and how he was oh so shocked and nearly fainted at the scene because he was so remorseful–sounds like a cop out to try to gain sympathy for the guy.

    -nichkhun has his license suspend. For what reason not sure.
    -he blew and 0.056% alcohol level but wasn’t charge with DUI
    -eye whitnes that both parties were failing to obey proper traffic laws.
    -the video is the only actual visual evidence besides whitness account
    -the motor cyclist suffer minor injuries but no hospital stay

    If eye whitness claim that both parties were driving recklessly its just bad. Whatever is in the video can either support that to some degree. But nichkhun getting his license suspended and paying any damage to the victim’s bike and addtional medical care treatment from the accident. Is about all that will happen here. Even with a charge of DUI. He’ll just get his lincse suspended for a short period of time unless he has a history. He would see jail time.

    DUIs and jail time only happen when someone has a history or has killed someone.

      • From what JYP said, they kicked him out because he apparently did something worse than the myspace issue. Whether or not what he did was really that bad, I think it’s pretty obvious that they didn’t want him anymore.

        I was looking for some sort of “stop” sign from the direction that Nichkhun’s car was coming from.

        It looks to me like he just blew through an intersection, but I don’t see anything obvious to suggest a right of way in either direction.

        • I don’t know a thing about Korean signs or driving but I think any good driver–or one who isn’t impaired by a substance–would know that whoever’s on the main road has the right of way. If there are no signs, at least be cautious enough to slow down, look both ways, and then keep going.

          In other words, what if two vehicles blew through their stop signs at a 4-way stop and ran into each other? Who would be at fault? Both drivers.

        • from what i’ve seen here in america, 4 way stops are only at intersections between two main roads (and its usually the side street who doesn’t have a right of way regardless of there’s a stop sign). but maybe in korea its different.

    • Dang those cars are parked whichever way lol. I’m use to cars on the right will be facing in that direction (right)… cars on the left will be facing well… left. But I do gotta say, I dunno how much the ‘up slope/down slope’ really affects them honestly, because the cyclsit’s side looks kinda up slope (but also too, it is google maps) but yeah I dunno if I can buy that one too fast. But I do know both the other sides of the roads they’re trying to cross (at least one of them did) gets narrowed a lot.

      Khun should do either stay a night in jail or do community service to make amends IMO.

      But thanks to JYP monies, there is no way he will stay in prison so months of community service will (hopefully) restore his image.
