As the world turns, so does the hole of shit that ONE HUNDRED and Cha Ga Won find themselves in deepen, as their legal losses continue to pile up. This time, it was VIVIZ‘s injunction being granted following the trio filing for one against BPM Entertainment back in early March based on unpaid settlement fees.
The court granted the injunction against the validity of their exclusive contract, which will free them to pursue activities as the main suit gets handled. Unsurprisingly, fulfilling the contract’s terms continues to be paramount, and BPM’s inability to do this was what did it, “According to the court’s decision, one of the key factors behind the ruling was the agency’s failure to pay settlement fees owed to the members. The court determined that each member was entitled to receive more than ~$73,000 unpaid settlement fees and concluded that ‘it is reasonable to find that the respondent violated its obligation to pay settlement fees.’” Furthermore, there was a lack of transparency from the company with regards to how much they were owed anyway, “The court noted that the settlement statements provided by the agency only listed revenue and expense figures without supporting documentation such as tax invoices or receipts. Furthermore, BPM failed to provide additional supporting materials or guidance on how the members could access and review the relevant records.“
BPM tried to argue that the delays were due to external issues that impacted Cha Ga Won, but the court unsurprisingly ruled essentially that it was not VIVIZ’s problem, “The alleged management takeover attempt by external forces and false media reports are circumstances unrelated to the applicants.“
VIVIZ’s lawyer further stated that the unpaid settlements only represent a part of what’s owed, which is what they’re hoping to bring forth in full during the main contract trial.
Obviously this bodes extremely well for VIVIZ in the main lawsuit, and to me it’s not even really a matter of whether the contract gets voided or not, but rather how much and how fast they’ll be able to get their backpay from the company.
